- Access our systems using bots, scrapers, or automated tools.

- Violate SMS, A2P, or email compliance regulations.

4. Intellectual Property

All content, software, trademarks, and materials provided within the Services are owned or licensed by LogicTrigger. User-uploaded content, data, or materials remain the property of the user. You may not reproduce, republish, or exploit any part of LogicTrigger’s proprietary content without written permission.

5. Subscriptions and Billing

Some Services require a paid subscription.

- Billing: Subscriptions are billed in advance and automatically renew unless canceled.

- Free Trials: Trials may require a payment method and auto-convert to paid plans if not canceled before the trial ends.

- Cancellation: Cancel anytime to stop future charges. Canceling does not refund charges already incurred. All subscriptions are billed month-to-month unless otherwise specified.

- Billing Failure: Non-payment may result in suspension and data loss.

- Fee Changes: We reserve the right to adjust fees with notice before your next renewal.

Carrier fees (e.g., phone, SMS) may apply and are not refundable.

6. Refund Policy

Refunds are provided at our sole discretion. Subscriptions, packages, and promotional rates are generally non-refundable. Refunds will not be issued for:

- Used services or projects already started.

- Custom builds or campaign launches.

- SMS, call, or email carrier charges.

- Promotional or discounted multi-month plans.

- Account cancellations due to violations of these Terms or abuse.

7. Service Modifications

We may modify, update, or discontinue any part of the Services at any time. We are not liable for interruptions, loss of access, or data resulting from such changes.

8. User Submissions

By submitting feedback or suggestions, you grant us a non-exclusive, royalty-free license to use them for any lawful purpose without compensation. This does not apply to proprietary content you upload for your own campaigns or accounts—you retain full ownership of that content.

9. Data Responsibility

You are responsible for backing up your data. We are not liable for data loss due to cancellations, non-payment, or service changes. We perform regular backups but do not guarantee full data restoration. You may request a data export before canceling or terminating your subscription, but we do not guarantee data access after account suspension or termination.

10. Termination

We may suspend or terminate your access without notice for any violation of these Terms. Upon termination, your right to use the Services ceases immediately.

11. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.”

We do not guarantee:

- Uninterrupted or error-free access.

- Specific results from using our Services.

- That the Services are free of viruses or harmful components.

- Any specific return on investment (ROI) or business outcomes.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

- Indirect or consequential damages.

- Loss of profits, data, or business.

- Claims exceeding the total amount paid by you in the past 3 months.

You agree to indemnify and hold harmless LogicTrigger, its affiliates, and team members from any claims, losses, or damages resulting from your use of the Services or your violation of these Terms.

Our Services may link to third-party sites or tools (e.g., Stripe, Calendly). We are not responsible for their content or practices. Use them at your own risk.

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in courts located in Texas.
